It's an inherent flaw in the system. The bot is programmed not to /whois the server in order to get information on users. If there were 400 users in a channel, imagine what would happen if the bot /whois'd each of them at once...
Instead it refers to their channel status (+v, +h, or +o). This information is sent to the client whenever a mode is set - it is not information that the bot must request.
We ask admins to counteract this by applying +v to themselves when they enter the channel so that the bot ignores them during idle kicks.
Since you've pointed it out, I'll consider writing a function that applies +v when the bot realizes that it can't kick a user.

It also accidentally banned Kwinnie from IRC.
It doesn't accidentally ban people. It will ban people who've been idling for too long or people who have said too many nicknames in a single line.
