nintendo warranty excuse? will it pass?

recently my girlfiends poor nintendo DS has broken on the hinge now i do not have a reciept BUT i made a note and put it with the ds
this note said it was a gift off a relative who has died (death so i cant ask for a receipt)
will it work?
if not how can i slip thru the cracks without a receipt i cant fake one cause my laptop died and i dont even have a printer anyway...

so basically will it work?
if not what will?

YOU could be honest and mail it in to the company asking for a replacement.

Go buy a new one, clean up & return the old one with the receipt. When they examine it, tell them it was like that when you opened it. Check for SN on box.
