well, let's say I have a stolen 2g iphone. It was not bought in Italy because they didn't sell it here. The SIM has already been locked, but the phone still works. I'm upgrading it and jailbreacking it, I guess I'll give it to a friend of mine for his birthday(I already own a 3g). is it safe to use or can they anyhow track me/my friend? what can I do to avoid issues?

they can track the IMEI, the phones serial number. So even if you put in another sim card, the network will b e able to tell the past history of the phone.

But lucky for you it's a iphone and you can change the imei

they can trace it but most of the time they wont bother. and ZiPhone has been known to brick iphones.

Apple will not track stolen iPhones, but the carrier can block the IMEI so the phone will not work. One option is to change the IMEI as said above, or sell it to someone in a country where IMEI blocking is not practiced. (Canada, etc)
