Think how much people's IQs vary? I may be more intellectually capable drunk than you are sober, or vice versa. Also autism and aspergers exist, as well as people who are just fucking stupid, downs syndrome, etc.
And what drugs? does drinking coffee make her too intoxicated to consent? it's shown that caffeine is dopaminergic and is likely to increase arousal and all. She could have not consented had she not had that starbucks, does that make it rape? What about medications, what if she's prescribed fucking ambien to sleep? you know how much that fucks people up?
Further, people's state of consciousness varies a lot naturally, not even going into the existance of PMS. Consider how fucking stupid and groggy you are in the morning if you haven't slept well. You're probably less capable of decision making than you are after a couple beers.
tl;dr "too intoxicated to consent" is the shittiest argument ever and nobody should be convicted on that charge unless the woman is literally unconscious. As a precautionary measure, I recommend subjecting all sexual partners to the turing test.
