Got an Open Container charge

So i'm pissed. I was NOT drinking, but the other 2 guys in the car were. When the cop got out of the car, the driver *i was in the passenger seat* took his beer and put it between my legs, right when the cop walked up. Now I have to go to court for this shit, and I swear i hadn't drank a drop.

So if i snitch on the guy when i go to court will that improve my chances of getting the charge dropped? Maybe if i get the other guy that was in the car with me to testify that i had not been drinking AT ALL and it wasn't even my car.

I'm in SC if that helps.

IDK about where you live, but here its illigal to have open liqour in the vehicle whether you're drinking or not

If you get the driver to admit it was his then you should be ok...I had a similar situation go down with paraphernalia... Tell the guy to own up or stash some meth in his car and make a anon tip..

No he didn't blow dui but after the incident he said that he told the cops it didn't belong to me, however I still got the charge because it was on my side of the car.

And how serious is an open container charge, is it almost as bad as a DUI?

Yet but the thing is the cops let us go, and they didn't fine him anything. Can they go back and charge him with something even though they had already let us go?

what i did was write up a statement in his name saying i had absolutely nothing to do with the alcohol in the car and he admits he threw it on me at the last second, and get him to sign it. can he get charged with anything?

Somebody please explain to me how doing what the driver did to a friend who wasn't drinking is not worse than 'snitching'. It's basically snitching, but for something the person didn't even do, and making sure they get caught. It's fucking lower.
