Following that logic though, what would be wrong with discussion about some hypothetical RC exchanges? It just seems silly to apply one type of logic to BI and another type of logic to RCs.
I mean I'm 99% sure that "hypothetical" schtick would be absolutely no defense to someone being prosecuted, it's only there to protect the people who run the site.
If someone was being prosecuted for a crime and the prosecution dug up some threads of the defendant talking "hypothetically" about some crime they've been accused of - they'd be able to use that. Obviously a prosecution couldn't be based only on some internet thread, but threads could be used as evidence, not to mention point to other activities DAs might be interested in.
And I believe there were some criminal cases regarding white collar crimes that people discussed on BI. I don't know if their threads in BI were used as evidence, investigative leads or anything though. I'd love to know if anyone could give me details on it though.
