I outed the pigs (Long)
So last night, me and O_RLY/Expl0itz were having our standard week day drinks. Some beers, a few glasses of jager/monster and chatting on IRC on opposite ends of his room, on different computers. Nothing out of the ordinary, I got a hold of a few other friends who wanted to drink so they picked me up before Expl0itz beddy time and we proceeded to the local gas station.
We pulled up and there were several cop cars, once again, nothing out of the ordinary. I walk in, wave to the employees that I know quite well from my daily liquor runs. I walk to the back, pick up three 40oz's of Magnum and head towards the register. While I do look suspicious, scummy bum lookin kid, bandanna around neck etc, they never fuck with me. Today I was not so lucky.
Two of the four pigs approach me and ask me for identification while Im waiting in line and I quickly and politely inqure; "Is there a problem officer? Have I dont something wrong? Am I being detained?" The officer laughs at me as I refuse to show ID and then his partner grabs me while he begins going through my pockets.
Theres several witnesses, two being the cashiers which I know quite well. The ladies that work at this place fucking LOVE me. They all call me by their appointed nickname;magnum. Being that theres witnesses around, I make it a point to loudly state that "what youre going is illegal. You cannot be doing this"
Guess where this story goes next? Yep. Handcuffed and in the back of the squad. I had a fake ID as I am only 20. We roll off to the station and the filthy pig scum make jokes about the felony Im receiving and such so in return I'm a smartass. This is where the things got weird. They didnt process me(finger prints, pictures, paper work) before placing me in the cell. I didnt think anything of it at the time so naturally I drifted in and out of sleep until they started waking people up to go to court.
I ask the officer who is recruiting people to the bus why I wasnt leaving and he said that I wouldnt be going anywhere for at least 24 more hours; due to the severity of my crime(being a FELONY), it would take longer, which was bullshit and I already knew that. A few hours later, the officer that arrested me comes in and brings me to get my finger prints and such, immediately after he had visited the gas station to talk to the employees. I know this because he joked "the ladies at Thorton say they see you a lot, sometimes 2-3 times a day"
Im then returned to my cell, under the assumption that I have quite some time to be here, and its already been about 11 hours. I took a nap and all the sudden I hear the door slam and the head pig opens my cell and demands I come out. I follow him to a desk where theres a piece of paper, along with all my possessions. He tells me to sign the paper so I ask what it is. Its an I-bond. I'm free! But why?
On my walk I decided to go over my paper work. The first paper I see is the I-bond paper. $1000? What the hell? I got popped with a fake when I was 17 and the i-bond was literally 10 times that amount; $10,000. I read on only to be even more surprised. I come to the papers stating my charges next...
Two pieces of paper, both titled "Misdemeanor Complaint." What the fuck? I got popped with a fake ID, thats a felony. I read on. The first charge is "Unlawful possession of an alcoholic beverage by a minor," and the second is "obstructing a peace officer." What the fuck?
Unlawful possession of an alcoholic beverage by a minor in that a person under the age of 21 years, knowingly possessed an alcoholic beverage, 3 bottles of cobra alcoholic beer. WHAT?! Hahaha, seriously? Thats garbage. I was definitely NOT in possession of them, considering I hadnt purchased them, therefor ownership had not moved from the gas station to me, I had not left the gas station with them, therefor I was NOT in possession of alcohol in any way shape or form.
Obstructing a peace officer in that he knowingl obstructed the performance of Ofc **** of an authorized actm in the performance of his official duties being an investigation in possession of an alcoholic beverage in that said defendant gave Ofc *** a fake date of birth in order to conceal his true age.
I now have the biggest fucking smile on my face. They fucked up! I WIN! What judge in their right mind is going to waste their time with these petty charges? Thats saying the fucking pig even shows up to court! I truly think they were not prepared to deal with someone who was fully aware of their rights, realized they fucked up, and let me off to cover up their shitty work.
tl;dr I spent 12 hours in jail with a felony charge and got off with 2 petty misdemeanors because I exercised my rights and the cops trampled them in front of several witnesses. Know your rights kids, know your rights

I was in the wrong by having fraudulent identification, yes, but they were in the wrong with the way they went about their work, being in front of several witnesses and on camera.

Man, good work. So many people seem eager to prostrate themselves before these bastards if only 'cause they're uniformed. Funny story, actually.
My uncle was driving back home from work one day, tired as fuck. As he is driving, he gets a cop driving right by his car. The cop proceeds to turn on his siren, and my uncle pulls over. At this point, my uncle's shitting bricks. He's about to fall dead asleep, and he's a bit groggy from tiredness. He lowers his window and asks the cop what he'd done wrong. The cop, who was a 250 pound redneck, told him viciously that he was in a bad mood and felt like pulling over the next guy he saw wearing a green shirt. My uncle was wearing a green shirt.
The cop got back in his car chuckling, and drove off. My uncle was completely thrown aback, and did fuck all about it. Idiot. I'd have had his ass in court sooner than he could pop another doughnut.

Actually to be honest I don't think you do know your rights. What they were doing was perfectly legal, as far as I know. I don't live in the USA, can't say for sure but AFAIK cops can search anyone if they have reasonable suspicion that something isn't right. You refusing to show them your (fake) ID is good enough. Why didn't you just show it to them and hope they didn't notice?

They didn't fuck up. You want to clarify what you think they did wrong?
And dude, you didn't "out" anyone, you spend 12 hours in jail they filled out a form and get to collect a fat paycheck. They fucking owned you.

Hobo: You've got grounds to sue, mate. A good lawyer could probably make you quite a bit of money off of this. I hadda friend who was wrongfully imprisoned due to a mistake concerning an outstanding warrant and took on the bulls for fifteen grand.

It's reasonable to provide identification to the police, but it's unreasonable for them to search you for it over something like holding booze in the middle of a gas station.
Why didn't you just show them your regular ID?
That being said, it would be legal for you to buy booze here. 21 as a legal age is a joke and a remnant.

The cops asked to see his ID
He basically told them to fuck off, implying he was underage with alcohol in his hands, and therefore committing an offense giving the police the right to search him
I'm no lawyer, but that sounds legit to me, you seem to know more about law, care to elaborate on what I'm missing here?

I will go to court, where the charges will be dropped.

How the fuck DIDNT I? A felony fake ID case means up to $10,000 in fines and 3 years jail time. I walked with a petty misdemeanor of "lying" about my age to the officer, WHICH I DIDNT EVEN DO.

I was arrested about 3 times in the past month with a total of about 13 misdemeanors. Fucking cops stop you for one thing and load you with a bunch of bullshit charges that make no sense.
I'm sure once i get to court most of them will be dropped but its such a fucking hassle having to be part of the fucking system. Having to go to court for shit you didn't even do. I had a trip planned to florida and now i cant even go because i have 3 differnt court dates in may.
Fuck the system.

He was arrested under illegal pretenses. He didn't tell them to fuck off, he asked them if there was an issue and the responded by performing an illegal search. In the United States the police CANNOT search your person without probable cause. If the police believe that they had probable cause they would have charged Hobo with felony possession of fraudulent identification, by charging him with a lesser crime they are basically admitting they had no grounds but still hopefully scaring him enough to not to exercise his rights and seek compensation.

Thank you, thats exactly what i was saying. They covered up their mistake by removing my felony and replacing it with some bogus charge that is going to be dismissed. I handled myself any knowledgeable individual would. I did not get out of control, I did not raise my voice and I did not resist arrest.
Yeah our local Anarchist scene is involved with the Chicago Cop Watch, so Ill probably see what theyve got to say about the situation.

Good luck in court. But don't be surprised if the cops are there with you. Given the circumstances of this, they will most likely show up. I've had friends in the past that go to court to challenge speeding tickets, and the cops have always shown up for those...that's probably the main reason I'd never want to become a cop: the long monotonous paperwork and having to constantly show up to court because some kid wanted to see the speed gun reading but didn't get to. Yes, those things would be more worse then getting shot at...

Do you know anythingn about stop and identify? They are allowed to stop and question me BUT NOT ALLOWED TO REQUEST IDENTIFICATION, which was the first thing he did. I asked if I had done something wrong and so forth, and I was restrained and illegally search.

As for how much I know about stop and ID laws? What I read on that page is the extent of my knowledge. I'm a Canadian highschool dropout, not a American law school graduate.
For that reason I can't say with ABSOLUTE certainty, but since half such laws seem to have been photocopied by the Canadian gov't and a little common sense (something my teachers always denied, fuck them all) that police are allowed to request a persons ID if they look underage and have alcohol in their possession, specifically if they are in the store about to purchase it.
If you were of legal age and the cops searched for then sure, you might have a case. But you weren't and you're GOING TO GET LAUGHED AT.

I don't know about the laws in the states, but in Canada, a cop can't search you in this case. Here they can only search you if they have strong evidence that you have a weapon, drugs, etc. In this case, the cop probably suspected underage drinking but that wouldn't be enough to search you.

Being that theres witnesses around, I make it a point to loudly state that "what youre going is illegal. You cannot be doing this"
Guess where this story goes next? Yep. Handcuffed and in the back of the squad. I had a fake ID as I am only 20. We roll off to the station and the filthy pig scum make jokes about the felony Im receiving and such so in return I'm a smartass. This is where the things got weird. They didnt process me(finger prints, pictures, paper work) before placing me in the cell. I didnt think anything of it at the time so naturally I drifted in and out of sleep until they started waking people up to go to court.
I ask the officer who is recruiting people to the bus why I wasnt leaving and he said that I wouldnt be going anywhere for at least 24 more hours; due to the severity of my crime(being a FELONY), it would take longer, which was bullshit and I already knew that. A few hours later, the officer that arrested me comes in and brings me to get my finger prints and such, immediately after he had visited the gas station to talk to the employees. I know this because he joked "the ladies at Thorton say they see you a lot, sometimes 2-3 times a day"
Im then returned to my cell, under the assumption that I have quite some time to be here, and its already been about 11 hours. I took a nap and all the sudden I hear the door slam and the head pig opens my cell and demands I come out. I follow him to a desk where theres a piece of paper, along with all my possessions. He tells me to sign the paper so I ask what it is. Its an I-bond. I'm free! But why?
On my walk I decided to go over my paper work. The first paper I see is the I-bond paper. $1000? What the hell? I got popped with a fake when I was 17 and the i-bond was literally 10 times that amount; $10,000. I read on only to be even more surprised. I come to the papers stating my charges next...
Two pieces of paper, both titled "Misdemeanor Complaint." What the fuck? I got popped with a fake ID, thats a felony. I read on. The first charge is "Unlawful possession of an alcoholic beverage by a minor," and the second is "obstructing a peace officer." What the fuck?
Unlawful possession of an alcoholic beverage by a minor in that a person under the age of 21 years, knowingly possessed an alcoholic beverage, 3 bottles of cobra alcoholic beer. WHAT?! Hahaha, seriously? Thats garbage. I was definitely NOT in possession of them, considering I hadnt purchased them, therefor ownership had not moved from the gas station to me, I had not left the gas station with them, therefor I was NOT in possession of alcohol in any way shape or form.
Obstructing a peace officer in that he knowingl obstructed the performance of Ofc **** of an authorized actm in the performance of his official duties being an investigation in possession of an alcoholic beverage in that said defendant gave Ofc *** a fake date of birth in order to conceal his true age.
I now have the biggest fucking smile on my face. They fucked up! I WIN! What judge in their right mind is going to waste their time with these petty charges? Thats saying the fucking pig even shows up to court! I truly think they were not prepared to deal with someone who was fully aware of their rights, realized they fucked up, and let me off to cover up their shitty work.
tl;dr I spent 12 hours in jail with a felony charge and got off with 2 petty misdemeanors because I exercised my rights and the cops trampled them in front of several witnesses. Know your rights kids, know your rights

Now sue for wrongful arrest, emotional trauma and reputational damage.
