As in: run, Forrest, run!

Getting caught stealing clothes is pathetic.

I can understand getting caught stealing $300+, anything below that, just pathetic..

Coming from a guy who's worked in that field...don't show loss prevention anything. They're not real law enforcement, they're just ordinary people hired by the store to protect merchandise. They have the authority to drag you back into the office in cuffs and remove their merchandise from you, but then they have to either let you go after a "reasonable" time or send you off with the police. Two hours is fucking ridiculous...were they just trying to question you the whole time or something?

You don't have to say anything or show them any ID, and it's illegal for them to search your pockets for it. If you've stolen less than $20, it's usually wise to just cooperate if you haven't acted like an asshole when they stopped you at the door, because they'll probably let you go with a warning, but you still shouldn't show them any ID or tell them your real name. Asking for your SSN is just weird, there's no possible reason they could need it.

If they just let you go, you're just in their records system, for that store and whatever larger retail chain it might be part of. But it's not the same as a police record, so nobody ever has to know but you and them. Stay away from that store and you'll be fine.

Like I said many times before, if you get caught shoplifting, you shouldn't be doing crime at all.

Quote:
#
Step 1

A merchant must provide probable cause for shoplifting, which must satisfy certain criteria, before you can be detained.
#
Step 2

A merchant must see you select the store merchandise. If an employee sees you after you have an item in your hand, it establishes doubt as to where the item came from and may not hold up in court.
#
Step 3

Someone must see you hide or carry away store merchandise or see you emerge from a fitting room with fewer items than when you went in.
#
Step 4

A witness must maintain visual surveillance of you throughout your stay in the store to provide probable cause for detaining you.
#
Step 5

You must have left the store's premises before you can be approached for not paying for items.
Know Your Rights
#
Step 1

If you are caught with merchandise, in many states a merchant has the right to detain and question you and have you arrested.
#
Step 2

In other states merchants do not have the right to detain you but can have you arrested, making a false arrest claims against them more common.
#
Step 3

Other customers or employees who do not satisfy the requirements of probable cause for your arrest may be considered unreliable witnesses.
#
Step 4

The use of excessive force in your detainment can be a violation of your rights. An organization that deals with civil rights such as the ACLU should be notified in serious cases (see Resources below).
#
Step 5

If you are not allowed to leave a room, a chair or other confined space, or if security guards or store employees are acting out of their jurisdiction of power, you may be entitled to claims of false imprisonment.
#
Step 6

Cooperate with the police if you are caught. Attempting to fight or flee will only make matters worse and may result in a more severe sentence.

What he ^ said. The more you know about what's happening to you during the apprehension, the better, because LP's are a bunch of lying motherfuckers that will break a lot of rules if they think they can get away with it. They may take chances even if they don't have all the correct steps listed above and just grab you anyways. They're never supposed to take people inside the bathroom, either, but they still do it, if they think their bosses won't find out.

On the flip side, police don't really care if they exactly followed all the steps, as long as a real shoplifter was caught in the act. The steps are really just legal liability protection for the store, to cut down on wrongful arrest lawsuits. I broke a lot of the rules once and got in serious trouble with the store, but the cops told me I hadn't done anything legally wrong.

I always keep around a small script pill bottle with sugar pills in it, in case I'm caught and they detain me. Then you pull an "anxiety attack" on them and they might just let you go.
